What is the Manufacturer Excise Tax?

Manufacturer Excise Tax is the tax levied on certain goods manufactured or imported to the country. Excise taxes are indirect taxes levied on certain products, services, and activities. These taxes are typically collected by manufacturers, importers, or retailers before being passed to the consumer.


The manufacturer excise tax is applied to goods such as tires, heavy vehicles, aircraft, and certain sporting goods.


Manufacturer Excise Tax (IRS No: 36,37,38,39)

The manufacturer excise tax (IRS No: 36, 37, 38, 39) is applicable on underground mined coal (No 36 and 37) and surface mined coal (No 38 and 39). This tax generally attaches upon the sale of the taxable article and is based on the sales price of the item. The coal tax is imposed on the sale of both underground mined and surfaced-mined.


In general, the manufacturer excise tax (IRS no: 36,37,38,39) is imposed on coal from mines located in the United States, sold by the producer, a tax equal to the rate per ton. Limitation on the tax imposed with respect to a ton of coal shall not exceed the applicable percentage of the price at which such ton of coal is sold by the producer. The manufacturer tax - IRS No: 36,37,38,39, is imposed on the producer of the coal. In the definition, the term ton refers to 2,000 pounds.


Coal from surface mines (IRS Num - 38,39)

This tax shall be treated as produced from a surface mine if all of the geological matter above the coal being mined above the coal is removed before the coal is extracted from the earth. Coal extracted by auger shall be treated as coal from a surface mine. The rate of tax on coal from surface mines shall be $0.55

Coal from underground mines (IRS Num - 36,37)

Coal shall be treated as produced from an underground mine if not produced from a surface mine. The rate of tax on coal from underground mines shall be $1.10


The applicable percentage for both shall be 4.4% of sales price. It is to be noted that the manufacturer excise tax (IRS No: 36,37,38,39) does not apply in case of lignite.

Other Types of Manufacturer Excise Tax (IRS Num - 108,109,113,40,97)

Manufacturer excise tax is of many types. Apart from the manufacturer excise tax (IRS No: 36,37,38,39), there are other types of excise tax. The types are listed below:

Tire Tax (IRS Num - 108, 109, 113)

This tax is imposed on taxable tires sold by the manufacturer, or importer of thereof at the rate of 9.45% for each 10 pounds so much of the maximum rated load capacity thereof exceeds 3500 pounds.


Gas Guzzler Tax (IRS Num - 40)

This tax is imposed on the sale by the manufacturer of each automobile, a tax determined in accordance with the following table. This term does not include any vehicle which is treated as a nonpassenger automobile under the rules which were prescribed by the Secretary of Transportation for purposes of section 32901.

Vaccine tax (IRS Num - 97)

This tax is imposed on any taxable vaccine sold by the manufacturer, producer, or importer thereof. The applicability of vaccine tax is as per the table below:
